The Servicemembers Civil Relief Act (SCRA)

Eligible Populations

Protection extends to full-time active-duty members across five military branches, reservists on federal active duty, and National Guard members on federal orders exceeding 30 days. Certain dependents and loan co-signers receive limited protections.

Interest Rate Protections

The SCRA caps interest at six percent (6%) per year on obligations incurred before military service. Servicemembers must provide written notice and military documentation to their creditors to activate this protection.

Collection Procedures

Creditors cannot pursue default judgments without appointing legal representation for servicemembers. Vehicle repossession requires DMDC database verification before proceeding. Mortgage foreclosures demand court orders during service and one year afterward.

The Defense Manpower Data Center maintains a searchable database at no cost for verifying military status, updated monthly by the Department of Justice. This resource enables creditors to confirm whether an individual qualifies for SCRA protections before taking collection actions.

Proposed Legislation

The Fair Debt Collection Practices for Servicemembers Act (H.R. 5003) proposes prohibiting collection threats regarding rank reduction, security clearances, or military prosecution. These additional protections would further shield active-duty service members from abusive collection practices that exploit their military service status.
